Amazon COBRA Notice Lawsuit Gets Boost From Magistrate Judge – Bloomberg Law

A former Services LLC worker notched an early win in her lawsuit over the company’s COBRA notices, when a federal magistrate judge recommended that she be able to pursue claims that the notices contained an “ominous warning.”
Plaintiff Teresa Lites adequately alleged that Amazon’s COBRA notices weren’t “written in a manner calculated to be understood by the average plan participant,” because they included an unnecessary and potentially inaccurate warning about criminal and civil penalties, Magistrate Judge Jacqueline Becerra said in a report.
